A lot will depend on whether it is a felony or a misdemeanor robbery. That he fought could elevate what would normally be a misdemeanor robbery. If felony, then what degree?

    (1) For a felony of the first degree, the prison term shall be three, four, five, six, seven, eight, nine, or ten years.

    (2) For a felony of the second degree, the prison term shall be two, three, four, five, six, seven, or eight years.

Since he fought, that could trigger in the factor of attempt to cause bodily harm in the commission of a robbery, which would make it a first or second degree robbery. http://codes.ohio.gov/orc/2911

Since the bottle would be valued at under $500, it would normally be classified as a misdemeanor. But the fighting complicates it. He needs a lawyer.
